In the changing room, devices and objects that may be damaged or pose a threat must be left behind. It is recommended to leave valuable items at home, in the hotel room, or in the deposit available at the hotel reception. The Company is not responsible for lost or stolen items within the premises of Spa & Wellness Kasprowy.
Individuals in poor health, with reduced physical ability, feeling unwell, or pregnant women should use Spa & Wellness Kasprowy and its facilities with particular caution. The Company is not liable for any consequences resulting from the use of Spa & Wellness Kasprowy by these individuals.
Individuals violating order or the provisions of these Regulations will be removed from the facility without the right to a refund of previously paid fees.
It is understood that purchasing accommodation, a ticket, a pass, or any other form of access to Spa & Wellness Kasprowy is equivalent to acknowledging and accepting the provisions of these Regulations.
Complaints, suggestions, and grievances should be directed to the manager of Spa & Wellness Kasprowy.
In accordance with the General Data Protection Regulation (EU) 2016/679 of April 27, 2016, on the protection of individuals regarding the processing of personal data and the free movement of such data (hereinafter: "GDPR"), we inform you that the administrator of personal data is Bachleda Hotel Sp. z o.o. with its registered office in Zakopane, ul. Krupówki 29, 34-500 Zakopane (hereinafter: "Company"), mailing address: 34-500 Zakopane, ul. Szymaszkowa 20, Bachleda Hotel Kasprowy, registered in the Register of Entrepreneurs by the District Court for Kraków-Śródmieście in Kraków, 12th Commercial Division of the National Court Register under KRS number 000436617, NIP 7361716545, with a share capital of PLN 6,000.00 ("Administrator").
We have appointed a Data Protection Officer (DPO), who can be contacted at the following email address: iod.r.andrzejewski@szkoleniaprawnicze.com.pl.
The Administrator processes personal data for the following purposes and on the following legal bases:
A. For booking treatments and providing SPA & Wellness services – i.e., concluding and fulfilling a contract (legal basis: Article 6(1)(b) GDPR – concerning regular personal data); in the case of special category personal data (which may be necessary in certain situations) – also based on the individual's consent (Article 9(2)(a) GDPR);
B. To remind about scheduled appointments via SMS, email, or other contact details – based on consent (Article 6(1)(a) GDPR);
C. To fulfill legal obligations imposed on the Administrator, e.g., accounting or tax obligations (legal basis: Article 6(1)(c) GDPR);
D. For commercial/marketing purposes, including adjusting the content sent – profiling. We clarify that your personal data may be subject to profiling. We automatically analyze and process statistics related to your data, such as treatment preferences, age, and frequency of visits. As a result of these activities, you may receive marketing content and commercial information tailored to your preferences and needs. These decisions will not be based solely on automated processing, including profiling, unless you provide consent (legal basis: Article 6(1)(a) GDPR in connection with Article 10 of the Act on Providing Services by Electronic Means and Article 172 of the Telecommunications Law);
E. For statistical purposes, data analysis, and customer satisfaction research (the legal basis for processing is the legitimate interest of the Administrator – Article 6(1)(f) GDPR);
F. If necessary, for the establishment, exercise, or defense of legal claims, which is our legitimate interest (Article 6(1)(f) GDPR);
G. For conducting video surveillance at the SPA & Wellness premises – to ensure safety and property protection, based on Article 6(1)(c) GDPR in connection with Article 22² § 1 of the Labor Code and Article 6(1)(f) GDPR, i.e., the legitimate interest of the Administrator, which is ensuring security and property protection. Video surveillance covers the following areas: swimming pool, jacuzzi, bubble pools, corridors, communication routes, emergency exits, and the gym.
We will store your data no longer than necessary:
A. Regarding the execution of concluded contracts – for the duration of their validity, and after their completion, until the expiration of any potential claims;
B. Regarding fulfilling legal obligations imposed on the Administrator related to business activities and contract execution, including particularly tax obligations – until these obligations expire;
C. Regarding data processing based on consent – until the consent is withdrawn;
D. Regarding data obtained from video surveillance – for a period of 30 days from the date of recording, and in cases where the recording is or may be evidence in proceedings under applicable law – for the period necessary as required by law;
E. Regarding processing carried out based on other legitimate interests of the Administrator – until they are fulfilled or until you object to such processing, unless there are legitimate grounds for further processing.
The recipients of personal data will be: an external entity providing and supporting the IT system – under an appropriate data processing agreement and ensuring that this entity applies adequate technical and organizational measures to protect the data. Additionally, your data may be shared or transferred to the following categories of recipients:
- Companies providing IT support services for the Hotel;
- Companies providing accounting services;
- Companies providing legal services;
- Companies providing marketing services for the Hotel;
- A security company (for video surveillance data). Data from video surveillance may be shared with individuals who demonstrate the need to access the recordings (a legitimate interest pursued by a third party), e.g., individuals affected by incidents recorded by the system's cameras.
Your data (in connection with the use of the services of a data processor) may be processed in the USA, i.e., outside the European Economic Area.
We clarify that the European Commission has determined an adequate level of data protection for the USA based on the Commission's Implementing Decision (EU) of July 10, 2023 – the EU-US Data Privacy Framework, which establishes principles for the secure and trusted transfer of personal data from the European Economic Area to the United States of America.
You have the following rights:
A. Under Article 15 of the GDPR, the right to access your personal data, including the right to obtain a copy of the data.
B. Under Article 16 of the GDPR, the right to request the rectification (correction) of personal data.
C. The right to data erasure – applicable under the conditions set out in Article 17 of the GDPR.
D. The right to restrict processing – applicable under the conditions set out in Article 18 of the GDPR.
E. The right to data portability – applicable under the conditions set out in Article 20 of the GDPR.
F. The right to object to processing – applicable under the conditions set out in Article 21 of the GDPR.
G. The right to lodge a complaint with the supervisory authority (President of the Personal Data Protection Office).
H. The right to withdraw consent for data processing (but only for personal data processed based on your consent). You have the right to withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. Consent can be withdrawn in the same manner in which it was given.

Providing data is voluntary but often necessary, e.g., to enter into an agreement with us or receive notifications. Failure to provide data may result in, for example, the inability to conclude or perform a contract.
The company is not responsible for photos taken and shared online by third parties not associated with the facility.
The Spa & Wellness Kasprowy area consists of four main zones available to users: the AQUA Zone, the RELAX Zone, the SPA Zone, and the GYM.
The AQUA, RELAX, SPA, and GYM zones are an integral part of the Hotel and the Spa & Wellness Kasprowy, and the general regulations and this Regulation apply to these areas.
Entry fees for the above-mentioned zones are charged according to the facility's price list. Additionally, designated areas have been established where users must adjust their activity plans according to their own skills and those of their dependents:
- The paddling pool area – up to 0.6 m depth,
- The swimming pool area – up to 1.2 m depth,
- Hot Tubs,
- The sauna area.
In case of any conflict between the general provisions of this Regulation (points 1-24) and the provisions related to specific zones, the provisions related to the respective zones shall apply.
RELAX ZONE: includes the following rooms: caldarium, tepidarium, aroma sauna, steam sauna, salt grotto, Zakopane sauna, Finnish sauna, infrared sauna, outdoor jacuzzi.
A. Before entering the sauna and steam room area, all metal objects should be removed, as they may cause burns.
B. Towels must be used by all users.
C. Before entering the textile-free area, swimsuits must be left in the changing room, and the body should be covered with a sheet or towel. In dry saunas, the towel should be spread out to prevent any part of the body from touching the wooden surface.
D. In the textile-free area, the following is prohibited: entering with clothing, swimwear, or footwear, lying or sitting directly on the wooden benches without using a towel, running, making noise, having loud conversations, jumping into the water, unnecessary use of the alarm bell, bringing alcoholic beverages, smoking, inappropriate behavior, or behavior considered socially indecent or offensive.
E. The textile-free area in the Relax Zone is available only to adults. The remaining part of the Relax Zone is available to children over 7 years of age during designated hours.
F. Each individual bathes in the sauna, steam room, or pool at their own risk and responsibility. Individuals in the saunas or steam rooms declare their physical and health fitness for such activities and take responsibility for their health.
G. It is not recommended to use the sauna and steam room after intense training, for people with circulatory issues (varicose veins, past heart attacks, ischemia, hypertension), or for individuals with diabetes.
H. Access to the saunas, steam rooms, and saltwater pool is prohibited for people showing signs of infectious skin diseases or other infectious conditions (such as fungal infections, warts, erysipelas, etc.), open cuts, poorly healing wounds, people with poor personal hygiene, breathing difficulties, balance disorders, aggressive behavior, women during menstruation, and people under the influence of alcohol or drugs that impair bodily functions.
I. When using saunas and steam rooms, users must strictly follow the instructions provided by the Spa & Wellness Kasprowy staff.
J. In case of adverse weather conditions, the outdoor jacuzzi may be temporarily closed and unavailable to guests. Temporary closure of the outdoor jacuzzi cannot be a basis for complaints or requests for compensation, including partial or full refunds for the entrance fee.
K. Due to weather conditions and the risk of slipping (e.g., local ice, frost, or condensation), extreme caution is required in the outdoor jacuzzi area, and running is strictly prohibited.
SPA ZONE: includes the following rooms: 4 SPA treatment rooms and a VIP room with a sauna and jacuzzi.
A. Using the services of the SPA Zone requires completing and signing a health questionnaire, which is considered a declaration that the client has no health contraindications to undergoing treatments and agrees to the terms of this regulation.
B. The SPA Zone is available to adults or minors with written consent from their parents or guardians, who must complete the health questionnaire in such cases.
C. All treatments are separately payable according to the SPA price list. D. Treatment reservations should be made at the SPA reception prior to the scheduled treatment.
E. It is recommended to reserve services at least a few days in advance. In the absence of a reservation, guests may use available services. Service reservations are confirmed after the staff checks availability.
F. Hotel guests may charge SPA services to their room with pre-authorization on their credit card at the main reception. This will be settled on the day of departure.
G. To ensure high-quality service, guests are required to arrive 15 minutes before the scheduled treatment time to complete a consultation form.
H. The scheduled treatment time is the starting time. If the client is late, the treatment will be shortened by the number of minutes they are late.
I. If a client makes a reservation but does not show up for the treatment, they will be charged 50% of the treatment price.
J. Treatments may be canceled free of charge at the SPA reception
K. Clients should notify the SPA reception about any contraindications or health issues (such as allergies, pregnancy, etc.) before receiving the treatment.
L. The SPA staff reserves the right to refuse to provide services if they consider the client’s health condition inappropriate for the treatment.
M. Payment for services provided in the SPA Zone is made at the hotel reception or SPA reception, either in cash or by credit card.
N. People will not be allowed to enter the SPA Zone if they: a) are under the influence of alcohol, b) are under the influence of drugs or other intoxicants, c) are behaving aggressively or inappropriately for the location.
O. SPA Zone staff reserve the right to interrupt a treatment if the customer's behavior is deemed inappropriate for the setting. In such a case, the full payment for the treatment will be charged.
P. The company is not responsible for items left in the SPA Zone (outside of designated and locked lockers).
Q. To increase the effectiveness of treatments, we recommend:
a) informing the therapist before the treatment about:
- any medications being taken,
- past illnesses,
- any potential contraindications,
b) using the pool, jacuzzi, and saunas always before treatments,
c) avoiding heavy meals at least one hour before the treatment,
d) avoiding sunbathing directly before and after the treatment,
e) do not shave your legs before a peeling treatment.
R. Sunbathing intensity should be limited to prevent sunburn, which may negatively affect the comfort of treatments.
A. The Hotel Gym is available for Hotel Guests (as part of the payment made for the stay and only during the paid hotel day) and for external individuals after prior payment of the fee specified in the Price List.
B. The Hotel does not refund the equivalent of unused services due to reasons attributable to the client.
C. The gym can be used at one's own risk (or by the guardian, or the group supervisor – applies only to minors) by:
a) organized groups,
b) sports clubs and sections under the supervision of an instructor or trainer after prior reservation,
c) individual persons from the age of 16.
D. The gym is prohibited for persons:
a) who are showing signs of alcohol consumption or under the influence of intoxicants,
b) with a medical contraindication,
c) under the age of 16, except for individuals mentioned in point C.
E. Persons using the gym are required to:
a) leave outerwear and footwear in the changing room;
b) use appropriate sports footwear that is clean and does not leave marks, scratches, etc., during use of the gym;
c) wear sportswear and, obligatorily, a dry, clean towel;
d) secure valuable items in their own locked locker;
e) follow safety rules when using the fitness equipment available in the Gym;
f) comply with health and safety, fire safety, and order regulations;
g) immediately report any faults or damage to the gym equipment to the staff;
h) return equipment to its place after completing exercises;
i) maintain cleanliness and order in the gym, changing rooms, and sanitary facilities;
j) comply with the instructions of the staff responsible for the operation of the facility;
k) not bring food into the gym.
F. The following is prohibited in the gym, including in the changing rooms and sanitary facilities:
a) smoking cigarettes, drinking alcohol, or using intoxicants;
b) bringing and using glass containers and other glass items;
c) bringing and using non-sporting equipment;
d) bringing dangerous items, explosives, pyrotechnic materials, or fire-hazardous materials;
e) bringing pets;
f) using gym equipment in a manner that threatens safety.
G. Individuals using the gym are solely responsible (including financially) for any damages, accidents, or other incidents that occur while using the gym. In the case of minors, the guardian is responsible.
H. A Hotel or Gym staff member is authorized to monitor the behavior of persons using the gym.
I. If property damage or other behaviors that threaten the safety or health of participants, or the security of property, are observed, the staff has the right to stop the exercises and order the person to leave the Gym.
J. The Company is not responsible for valuable items left in the Gym outside of the locked lockers.
